೩೧೭(ಜೆ)ಕಲಂ ಸಂಪೂರ್ಣ ಜಾರಿಯಾಗುವವರೆಗೂ ಯಾವುದೇ ಸರ್ಕಾರಿ ನೇಮಕಾತಿಗಳನ್ನು ಮಾಡದಿರುವಂತೆ ಹೈ.ಕ.ಹೋರಾಟ ಸಮಿತಿ ಆಗ್ರಹ.

 ಭಾರತ ಸರ್ಕಾರ ಸಂವಿಧಾನದ ೩೭೧ (ಜೆ) ಕಲಂ ತಿದ್ದುಪಡಿ ತಂದು ಈ ಭಾಗದ ಜನರಿಗೆ ಮೀಸಲಾತಿ ನೀಡಿದೆ ಹಾಗೂ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸರ್ಕಾರ ಹೃದ್ರಾಬಾದ್ ಕರ್ನಾಟಕಕ್ಕೆ ಸಂವಿಧಾನದ ೩೭೧(ಜೆ) ಕಲಂ ಅಡಿಯಲ್ಲಿ ಕಾನೂನು ರಚಿಸಿ ಜಾರಿಗೆ ತಂದಿರುವುದು ಹಿಂದುಳಿದ ಈ ಪ್ರದೇಶದ ಸಾವಿರಾರು ಅವಕಾಶ ವಂಚಿತರ ಮನೋಬಲವನ್ನು ಹೆಚ್ಚಿಸಿದೆ. ಕರ್ನಾಟಕ ರಾಜ್ಯದಲ್ಲಿ ೧೯೫೬ರಂದಲೂ ಮಲತಾಯಿ ಮಕ್ಕಳಂತೆ ಬದುಕಿದ್ದ ಹೈದ್ರಾಬಾದ ಕರ್ನಾಟಕದ ಜನತೆಗೆ ಈ ೩೭೧ಕಲಂ ತಿದ್ದುಪಡಿ ಒಂದು ಊರುಗೋಲು ಆಗಿತ್ತು. ಆದರೆ ರಾಜ್ಯ ಸರ್ಕಾರ ಆ ಊರುಗೋಲನ್ನು ಕಿತ್ತುಕೊಳ್ಳಲು ಹೊರಟಿದ್ದು ಆಶ್ಚರ್ಯವಾಗಿದೆ ಎಂದು ಹೈ.ಕ.ಹೋರಾಟ ಸಮಿತಿಯ ರಾಜ್ಯ ಉಪಾಧ್ಯಕ್ಷ ಡಾ||ರಜಾಕ್ ಉಸ್ತಾದ್ ಹಾಗೂ ಪ್ರಧಾನಕಾರ್ಯದರ್ಶಿ ಈ.ಧನರಾಜ ಪತ್ರಿಕಾ ಪ್ರಕಟಣೆಯಲ್ಲಿ ವಿಷಾದ ವ್ಯಕ್ತಪಡಿಸಿದ್ದಾರೆ.
ಈ ಕಲಂ ಅಡಿಯಲ್ಲಿ ಸಿಗುವ ಎಲ್ಲ ಸೌಲಭ್ಯಗಳನ್ನು ಹೈದ್ರಾಬಾದ ಕರ್ನಾಟಕದ ಜನತೆಗೆ ದೊರಕುವಂತೆ ಆಳುವ ಸರ್ಕಾರಗಳು ಕಾಳಜಿವಹಿಸಿ ಮಾಡಬೇಕು. ಅದೇರೀತಿ ಈ ಭಾಗದ ಜನಪ್ರತಿನಿಧಿಗಳು ಎಚ್ಚೆತ್ತು ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಅದನ್ನು ಜಾರಿಗೊಳಿಸುವ ಕೆಲಸ ಮಾಡಬೇಕಿದೆ. ಆದರೆ ಕಾನೂನು ರಚಿಸಿದ ಸರ್ಕಾರದ ಅಧಿಕಾರಿಗಳೆ ಅದನ್ನು ಉಲ್ಲಂಘಿಸಿ ನೇಮಕಾತಿ ಮಾಡುತ್ತಿರುವುದು ನಮಗೆಲ್ಲ ದಿಗಭ್ರಮೆ ಮೂಡಿಸಿದೆ. ಈಗಾಗಲೆ ಕರ್ನಾಟಕ ರಾಜ್ಯ ಸರ್ಕಾರ ೨೦೧೩ರ ಫೆಬ್ರವರಿ ೨೩ರಂದು ಆದೇಶ ಹೊರಡಿಸಿ ಹೈ.ಕ.ದಲ್ಲಿ ನಡೆಯುತ್ತಿರುವ ಎಲ್ಲ ನೇಮಕಾತಿಗಳನ್ನು ತಡೆಹಿಡಿದಿತ್ತು ಕಳೆದ ತಿಂಗಳಿ ಮತ್ತೊಂದು ಆದೇಶ ಮಾಡಿ ೦೧/೦೧/೨೦೧೩ರ ನಂತರ ಹೊರಡಿಸಲಾದ ಎಲ್ಲಾ ಅಧಿಸೂಚನೆಗಳನ್ನು ವಾಪಾಸು ಪಡೆದು ಹೈ,ಕರ್ನಾಟಕಕ್ಕೆ ಮೀಸಲಾತಿ ನಿಗಧಿಗೊಳಿಸಭೇಕೆಂದು ಆದೇಶಿಸಿದೆ, ಆದರೆ ಸರ್ಕಾರದ ಆದೇಶಗಳನ್ನು ಉಲ್ಲಂಘಿಸಿ ವಿವಿಧ ಇಲಾಖೆಗಳಲ್ಲಿ ಹಲವಾರು ಹುದ್ದೆಗಳ ನೆಮಕಾತಿ ಅಧಿಸೂಚನೆಯನ್ನು ಹೈದ್ರಾಬಾದ ಕರ್ನಾಟಕದ ಅಭ್ಯರ್ಥಿಗಳ ಮೀಸಲಾತಿ ಹೊರತುಪಡಿಸಿ ನೀಡಲಾಗಿದ್ದು ಮತ್ತು ಕೆಲವೊಂದು ಇ;ಲಾಖೆಗಳಲ್ಲಿ ತರಾತುರಿಯಲ್ಲಿ ನೇಮಕಾತಿ ಆದೇಶಗಳನ್ನು ನೀಡಲಾಗಿದೆ. 
ಉದಾಹರಣೆಗೆ  ವಿಶ್ವೇಶ್ವರಯ್ಯ ತಾಂತ್ರಿಕ ವಿಶ್ವವಿದ್ಯಾಲಯ ಬೆಳಗಾವಿಯು ೩೬ಮತ್ತು ೪೮ವಿವಿಧ ಹುದ್ದೆಗಳನ್ನು ಖಾಯಂ ಆಗಿ ನೆಮಕಾತಿ ಮಾಡಿಕೊಳ್ಳಲು ದಿನಾಂಕ೧೯/೦೩/೨೦೧೩ರಂದು ನೆಮಕಾತಿ ಆದೇಶವನ್ನು ನೀಡಿದೆ, ಕೆ.ಎಂ.ಎಫ್,ಬೆಂಗಳೂರು ೨೦೭ ಮತ್ತು ೦೪ ಖಾಯಂ ಹುದ್ದೆಗಳನ್ನು ನೇಮಕಾತಿಮಾಡಿಕೊಳ್ಳಲು ದಿನಾಂಕ೦೪ನವೆಂಬರ್  ಹಾಗೂ೧೬ನ ಸೆಪ್ಟೆಂಬರ್ ೨೦೧೩ರಂದು ನೇಮಖಾತಿ ಆದೇಶ ನೀಡಿದೆ, ಆರೋಗ್ಯ ಇಲಾಖೆ( ಏಡ್ಸ್ ನಿಯಂತ್ರಣ ಸಂಸ್ಥೆ)ಬೆಂಗಳೂರು ೧೮೪ ಗುತ್ತಿಗೆ ಆಧಾರಿತ ಹುದ್ದೆಗಳನ್ನು ನೇಮಕಾತಿಮಾಡಿಕೊಳ್ಳಲು ದಿನಾಂಕ೦೭/೧೦/೨೦೧೩ರಂದು ನೇಮಕಾತಿ ಆದೇಶವನ್ನು ನೀಡಿದೆ, ಇದರಂತೆ ಸೊಸೈಟಿ ಫಾರ್ ಕರ್ನಾಟಕ-ಜರ್ಮನ್ ಸಿಲ್ಕ್ ಡೆವೆಲಪ್‌ಮೆಂಟ್ ಸೆಂಡರ್ ಕಾರ್ಮಿಕ ಇಲಾಖೆ, ಆರೋಗ್ಯ ಇಲಾಖೆ,ಬೆಂಗಳೂರು ಹಾಗೂ ಬೀದರ್, ಕರ್ನಾಟಕ ರಾಜ್ಯ ವಸತಿ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳಸಂಘ,ಬೆಂಗಳೂರು ಇನ್ನಿತರ ಇಲಾಖೆಗಳಲ್ಲಿ ಕಾನೂನು ಉಲ್ಲಂಘಿಸಿ ನೇಮಕಾತಿ ಆದೇಶ ಮಾಡುತ್ತಿದ್ದು ಕಾರಣ ಸರ್ಕಾರವು ಕೂಡಲೇ ಎಲ್ಲಾ ನೇಮಕಾತಿ ಅಧಿಸೂಚನೆ ಹಾಗೂ ನೇಮಕಾತಿ ಆದೇಶಗಳನ್ನು ಹಿಂದಕ್ಕೆ ಪಡೆದು ಹೈದ್ರಾಬಾದ್ ಕರ್ನಾಟಕಕ್ಕೆ ಸಂವಿಧಾನ ಬದ್ಧ ಮೀಸಲಾತಿಯನ್ನು ನಿಗಧಿಗೊಳಿಸಿ ಮರು ಅಧಿಸೂಚನೆಯನ್ನು ಹೊರಡಿಸಲು ಸೂಕ್ತ ಆದೇಶ ನೀಡಬೇಕು ಅಲ್ಲದೇ  ಈ ಕುರಿತು ಜಾಣ ಮೌನ ಪ್ರದರ್ಶಿಸುತ್ತಿರುವ ಹೈ.ಕ.ಜನಪ್ರತಿನಿಧಿಗಳು ಈಗಲಾದರೂ ಎಚ್ಚತ್ತುಕೊಂಡು ಬರುವ ಅಧಿವೇಶನಗಳಲ್ಲಿ ಸರಿಪಡಿಸಬೇಕು ಇಲ್ಲವಾದಲ್ಲಿ ಅವರುಗಳ ನಿವಾಸಗಳ ಎದುರು ಉಗ್ರ ಪ್ರತಿಭಟನೆ ಕೈಗೊಳ್ಳಲಾಗುವುದೆಂದು  ತಿಳಿಸಿದ್ದಾರೆ.

Hyderabad Karnataka Special Package For Jobs-371(J)

Reservation in education, jobs in Hyderabad-Karnataka notified

The provisions of Article 371 (J) of the Constitution, aimed at bringing about all-round development in six districts of the Hyderabad-Karnataka region — Gulbarga, Yadgir, Bellary, Bidar, Raichur and Koppal, will come into effect straightway with Governor H.R. Bhardwaj approving relevant notifications on Tuesday ensuring reservation in employment and education.
The Governor has approved four important notifications as provided for under the 118th amendment — Article 371 (J) — to the Constitution and, among other things, this will enable the formation of the Hyderabad-Karnataka Region Development Board Order 2013. Henceforth, the Governor would play a significant role in the development of the region. The other notifications are the Karnataka Educational Institutions (Regulations of Admission in the Hyderabad-Karnataka Region) Order 2013, which provides for reservation of 70 per cent of the available seats in Hyderabad-Karnataka Region and 8 per cent seats in State-wide institutions, the Karnataka Public Employment (Reservation in Appointment for Hyderabad-Karnataka Region) Order 2013, which provides for the creation of a local cadre and reservation in the Hyderabad-Karnataka region as: Group A Junior Scale — 75 per cent, Group B — 75 per cent, Group C — 80 per cent and Group D — 85 per cent, besides reservation of 8 per cent of the posts in the State-level offices or institutions or apex institutions.
Mr. Bhardwaj has, by an order, also notified the Karnataka Private Unaided Educational Institutions (Regulations of Admission in the Hyderabad Karnataka Region) Order 2013, which provides for reservation of 70 per cent of the available seats in every course of study in any regional university or educational institution referred to in the First Schedule, 8 per cent of the available seats in every course of study in a State-wide university or a State-wide educational institution. Among the States that enjoy a special status under Article 371 are Andhra Pradesh (Telangana, Rayalaseema and Andhra), Maharashtra (Marathwada and Vidarbha), Gujarat (Kutch and Saurashtra), Nagaland, Goa, Manipur, Assam, Mizoram, Sikkim and Arunachal Pradesh. Andhra Pradesh, Gujarat and Maharashtra were accorded the status in 1956, and subsequently (in 1973 — 32nd amendment), Andhra Pradesh was segregated from this group. Given the provisions in the Constitutional amendment (which was approved by Parliament), the President (the Presidential Order) has entrusted special responsibility to the Governor to oversee the development of the region apart from the reservations in education and employment.
The all-important amendment to Article 371 came about at a time when Karnataka was heading for elections to the Legislative Assembly.
It is common knowledge that all political parties have over the past four decades appealed to the Union government of the day to enable a special status to the districts of the Hyderabad-karnataka region which have, by and large, remained backward since the reorganisation of States in 1956. It is another matter that the D.M. Nanjundappa committee report had made certain special recommendations for the overall development of the region, with funds drawn from the State’s coffers but a special provision made under the Constitution is now expected to make a difference.

‘Government deceiving people’

The Hyderabad Karnataka Horata Samiti has accused the State government of deceiving people by not implementing the notification ensuring reservation in employment and education under Article 371 (J).
Addressing a joint press conference here on Saturday, Razak Ustad, vice-president of the Central unit, S. Pannaraj and T.G. Vittal, president and vice-president of the district unit respectively, criticised the government for going ahead with recruitment in various government departments and depriving job opportunities to the youth in Hyderabad Karnataka region.
“The government has been unfair to the Hyderabad Karnataka region. The government not implementing the notification providing reservation for those in the Hyderabad Karnataka region, has come as a shock to us,” Mr. Razak said. Citing examples, Mr. Pannaraj said the recruitment process in several government-run institutions including Visvesvaraya Technological University, Karnataka Milk Federation, and the Department of Health were underway.
He demanded that the notification for recruitment already issued be withdrawn and the recruitment be annulled.
In addition, fresh notification should be issued with seats reserved for the Hyderabad Karnataka region, he said.
Mr. Razak alleged that the officials, particularly from the southern region, were not keen on extending the benefits of Article 371 (J) to the Hyderabad Karnataka region. The government had already opened a separate cell to monitor the extension of benefits under Article 371 (J), but the region is being deprived of the the benefits.

Separate development board for Hyderabad-Karnataka region approved by Union cabinet.

Approval of a separate board for Hyderabad-Karnataka region, that had got special status under Article 371-J in December 2012, is great news for those of us, who suffered injustice in all fields since independence. The region, which had got freedom in September 1948, after a delay of almost one year from Hyderabad Mizam, is still far-away from development.

The newly approved Hyderabad-Karnataka Development Board (HKDB) will be statutory in nature and it will quash the existence of the current HKDB constituted by the state government. As the president of India is empowered to entrust the state governor to establish a separate board to ensure equitable allocation of funds in the state’s budget to meet the development needs of the region, we feel like it is another kind of freedom to achieve development on par with any other developed regions of the nation.

After establishing the HKDB, our development works or projects will be approved by planning commission.

People of the region have received Rs1,532 crore from the state between the period of 1992 and 2013 and Rs900 crore was just utilised for construction of community halls in the region.

And that was all the development we saw in 21 years. Now, we hope something more from new the HKDB, under which a committee will be formed by the governor under the chairmanship of in-charge minister of any district of the region on rotation basis of one year.

The committee will involve six MLAs, one MLC, one MP and one ZP president. It should be remembered that their tenure in the committee will be only one year and they will be replaced with their counterparts as the tenure is based on rotation system.

As the board will have a secretary level official of the government as its secretary and regional commissioner, and deputy commissioners of six districts–Gulbarga, Yadgir, Raichur, Bidar, Koppal and Bellary–as its members.

I feel the board will hold responsible both legislature and executive wings of the democracy, and it will act on the wishes of the people. The board itself will decide developmental works and send it to the governor, who will include it in the state budget by sending it to assembly.

Finally, projects will be approved by the planning commission. There will be no budgetary limit to frameworks or projects. Even the board will have power to sanction primary and high schools, which can eradicate problem of illiteracy and scarcity of skilled employees.

Currently, the region is facing scarcity of skilled workers in all sector. As many as 60% of the posts are vacant at government level. Lower level officials are equipped with additional responsibilities of other posts. The board will be a best instrument to accelerate development in all sense.

Article 371(J)

What is Article 371(J)
This article grants special status to the six backward districts of Hyderabad-Karnataka region for establishing a separate development board.

This board will undertake the responsibility to see that adequate funds are allocated for the development of the region.

The article also calls for local reservation in education and government jobs (domicile requirement). One must be a resident of the given area for getting admission in colleges, getting jobs, making land purchases, and contesting elections.

The 118th Constitutional Amendment Bill 2012 was introduced in the Lok Sabha in September by Union Home Minister Sushilkumar Shinde to insert Article 371(J).

A resolution to make special provisions for the Hyderabad-Karnataka region was passed by the Legislative Assembly and Council of Karnataka in March 2012.

Hyderabad-Karanataka is a region located in the north-east Karnataka. It is a Kannada-speaking region of erstwhile Hyderabad State ruled by the Nizams of Hyderabad until 1948. After merging with the Indian Union, the region was the part of Hyderabad State until 1956.
